Terms and conditions

This English version is a convenience translation. In case of doubt, the German version is the legally binding one.

1. Scope & provider

These terms apply to the use of NODE64, offered by x64 GmbH, Am Eisenstein 10, 45470 Mülheim an der Ruhr, Germany. They apply to consumers and businesses alike.

2. Service description

NODE64 is a monitoring and recommendation platform: an agent collects data on your devices, analysis happens on our servers. This does not constitute a promise of absolute security.

3. Registration & account

Sign-in is passwordless via magic link. You keep your email account secure and provide accurate information.

4. Plans & payment

There are three plans: Free, Supporter and Business. Prices include statutory VAT and are billed monthly or yearly via Stripe. Subscriptions renew automatically but can be cancelled at any time; the period you paid for runs out normally. After that the Free plan and its limits apply.

5. Availability

We aim for high availability but do not promise a service level on the Free plan. Maintenance windows are announced where possible. [Open: service level for Business if applicable]

6. Recommendations & scripts (liability)

All recommendations, commands and fix scripts are assistance; applying them is your own responsibility. We are not liable for damage resulting from their use as far as legally permitted; liability for intent, gross negligence and injury to life, body or health remains unaffected.

7. Your obligations

The agent may only be used on your own systems or systems you are explicitly authorised to monitor. Tampering with the platform is prohibited.

8. Measurement network “NODE64 Sonar”

Participation is voluntary, enabled explicitly per device and revocable at any time. You acknowledge that measurement traffic originates from your own IP address and that you will only request permissible measurements. NODE64 may refuse, throttle, limit or block measurement jobs at any time and may suspend accounts in case of abuse. There is no entitlement to a certain number or availability of measurements.

9. Data protection

Our privacy policy applies.

10. Term, cancellation, account deletion

You can delete your account yourself at any time. Deletion irreversibly removes the stored data.

11. Changes to these terms

We announce changes in good time; you may object to them and end the contract.

12. Final provisions

German law applies. For businesses, the place of jurisdiction is the registered seat of x64 GmbH. Should any provision be invalid, the remainder stays in force.
